Intrit LLC ("we," "us," or "our") operates the Open Water Swim mobile application and Apple Watch companion app (the "App"). We are committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our App.
Please read this Privacy Policy carefully. If you do not agree with the terms of this Privacy Policy, please do not access the application.
1. Information We Collect
We only collect information necessary to provide and improve the core functionality of the App—tracking your swims, showing your results, and connecting you with friends.
A. Account and Profile Data
You have the option to use the App without logging in. If you choose to create an account, we use Firebase Authentication to securely manage your login. We may collect your email address, name, and profile picture.
B. Health and Fitness Data (Apple HealthKit)
To provide accurate swim tracking, our watchOS App requests read and write access to Apple’s HealthKit (Apple Workouts). With your explicit permission, we collect:
- Heart Rate during your swim.
- Active Energy (Calories) burned during your swim.
- Workout duration and timestamps.
(Note: We do not collect or use swim stroke count).
C. Location Data
Because this is an open water swim tracker, we require precise GPS location data to map your swim routes. This location data is only collected while you are actively recording a workout via the App or Watch App.
D. Social and Group Data
If you choose to add friends or participate in group swims, we collect data regarding your connections and the group workouts you participate in to display these activities to you and your selected friends.
E. Usage, Analytics, and Crash Data
We use Google Analytics for Firebase and Firebase Crashlytics to understand how the App is used and to fix technical bugs. This data is generally anonymous and includes your device type (e.g., Apple Watch Ultra, iPhone 15), operating system (iOS/watchOS version), IP address, session duration, and crash reports.
2. Apple Health Data Policy (Strict Compliance)
We adhere strictly to Apple’s App Store Review Guidelines regarding health and fitness data. Regarding Apple HealthKit data, Intrit LLC explicitly affirms the following:
- No Selling of Health Data: We will NEVER sell your HealthKit data to data brokers, advertising platforms, or any other third parties.
- No Advertising Use: We will NEVER use, share, or disclose your HealthKit data for advertising, marketing, or other use-based data mining purposes.
- Limited Core Use: Your HealthKit data is used exclusively to provide health and fitness tracking services directly within the Open Water Swim app (e.g., displaying your workout metrics and mapping your swim).
- Local & Secure: HealthKit data is treated with the highest security. You can manage or revoke the App's access to HealthKit at any time via the Apple Health app on your iPhone.
3. How We Use Your Information
We use the information we collect to:
- Record, map, and analyze your open water swims.
- Create and manage your user account.
- Facilitate social features, allowing you to view friends' activities and participate in group swims.
- Provide customer support and respond to inquiries.
- Identify and fix app crashes and improve overall App performance.
4. How We Share Your Information
We do not run third-party advertisements in the App, and we do not sell your personal data. We only share your information in the following limited circumstances:
- With Other Users (Social Features): If you create an account, add friends, or join group swims, your profile information (name, avatar) and your shared swim results (routes, times, metrics) will be visible to those specific friends or group members.
- With Service Providers: We share necessary data with trusted third-party service providers who help us operate the App, specifically Google (Firebase) for secure user authentication, database hosting, analytics, and crash reporting.
- For Legal Obligations: We may disclose your data if reasonably necessary to comply with a legal process, such as a court order or subpoena, or to protect the rights, property, or safety of Intrit LLC, our users, or others.
5. Data Retention and Account Deletion
We keep your personal information only as long as you have an active account or as needed to provide you with the App's services.
How to Delete Your Data:
You have the right to request the deletion of your account and all associated data. You can delete your account directly within the Open Water Swim iOS App by navigating to Settings > Account > Delete Account.
Alternatively, you can email us at support@openwaterswim.app to request manual account and data deletion. Upon deletion, your personal data and swim history will be permanently removed from our Firebase databases.
6. Your Privacy Rights (CCPA & GDPR)
Depending on your location, you may have specific rights regarding your personal data:
- Right to Access: You can request a copy of the personal data we hold about you.
- Right to Rectification: You can request that we correct inaccurate or incomplete data.
- Right to Erasure (Right to be Forgotten): You can request the deletion of your data as outlined in Section 5.
- Right to Opt-Out: Because we do not sell your data or serve third-party ads, there is no need to opt out of data sales.

7. Children's Privacy
The App is not intended for use by children under the age of 13 (or under 16 in certain European jurisdictions). We do not knowingly collect personal information from children. If we become aware that we have collected personal data from a child under the appropriate age threshold without parental consent, we will take immediate steps to delete that data.
8. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will notify you of any significant changes by updating the "Effective Date" at the top of this policy or by providing a prominent notice within the App.
